Aliso Viejo is one of the youngest cities in Orange County and it looks it: master-planned tracts, regular lot geometry, and a homeowners association on nearly every street. That combination makes ADU feasibility here unusually predictable. The lots are small, so the question is rarely whether a plan fits in the abstract and almost always whether it fits your specific rear yard once setbacks and the association’s architectural standards are both satisfied. We answer that with a tape measure before anything else.
How many ADUs actually get built in Aliso Viejo?
Aliso Viejo does not currently file a complete ADU permit count in the State’s Annual Progress Report data, so we publish the county picture here instead of repeating a city number we know is incomplete. ADUs were 33.7% of every home permitted in Orange County in 2025 (about one in every three), and 25.9% of every home permitted statewide. What does an ADU builder in Aliso Viejo actually do?

What is different about building an ADU in Aliso Viejo?
Three rulebooks apply, and the city says so plainly on its own ADU page: state law, the Aliso Viejo Municipal Code, and the California Building Code. The city publishes its general zoning requirements, setbacks and height among them, next to pre-approved plans intended to shorten plan check. Reading the zoning sheet before choosing a plan is the whole game on a compact lot, because a plan that clears the code on paper can still fail to fit behind a house that already sits close to its rear setback.
The state has looked at this ordinance. HCD issued a formal ordinance review letter for Aliso Viejo dated June 25, 2024, which is a useful thing for an owner to know: where a local standard conflicts with state law, the state text governs, and HCD review letters are how those conflicts get identified. If a requirement seems to go beyond what state law allows, it is a fair question to raise rather than a rule to accept. Height is the local flashpoint. The council has approved a two-story ADU that exceeded the ordinary height limit through a conditional use permit, which tells you two things: a second story is possible here, and it is a discretionary approval rather than a ministerial one. That is a different risk profile from a single-story unit, which on a code-compliant design is approved ministerially with no hearing. We price and schedule the two paths separately, because they are not the same project.
The association is the other half of the work. State law prevents an association from prohibiting an ADU on a single-family lot, and it still permits reasonable architectural standards, so the design conversation in Aliso Viejo is about matching materials, roof form and color rather than about permission. Neighboring Laguna Hills runs the same combination of association review and small lots, and Mission Viejo adds slope on top of it. Aliso Viejo sits closest to Laguna Hills in practice.
On lots this size the unit has to be designed to the yard rather than chosen from a catalogue. A compact one-bedroom placed to preserve a usable patio rents better and resells better than a larger unit that consumes the entire back yard, and the difference is a siting decision made in the first hour on site. Two city documents belong in the budget conversation before design. Aliso Viejo publishes a building permit fee schedule, and it maintains a separate Orange County Fire Authority information page. Fire review is the item owners most often leave out of a schedule, because it runs alongside the building review rather than after it, and on a compact lot with limited access it can shape where the unit sits. We check both at the start rather than treating them as paperwork that appears later.
One state provision is worth knowing on a small lot, because it changes what size is efficient: an ADU under 750 square feet of habitable floor area is exempt from development impact fees, and larger units are charged proportionately. On parcels where the yard only comfortably takes a one-bedroom anyway, that threshold turns a design constraint into a financial advantage. Sizing at 749 square feet rather than 800 is occasionally the single cheapest decision in the whole project, and it is made at the sketch stage or not at all.
What the compact geometry means in practice is that siting is decided before sizing, and that the two questions are not separable. On a master-planned rear yard the unit has to clear the rear setback, leave a usable outdoor space, keep a path to the side gate wide enough for construction access, and sit where the sewer and panel runs are short. Satisfy all four and the plan almost draws itself. Miss one and a plan that looked fine on paper turns into a redesign after the first site visit, which is the most avoidable delay in this business.
What does California law guarantee an ADU owner in Aliso Viejo?
A city ordinance sits on top of state law, never underneath it. Four sections of the Government Code decide what Aliso Viejo can and cannot require of your project. Each one links to the full text on the Legislature’s own site, so you can read the wording rather than take our summary for it.
